Terms and Conditions ("Terms")

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the www.nashvilleforhire.com and www.nashvilleforhire.store websites operated by Nashville For Hire("us", "we", or "our").

 

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

 

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

General 

 

Nashville For Hire reserves the right to curate marketplace content by pausing or deleting any service or account based on it's sole discretion.

 

Nashville For Hire provides a venue to introduce Users who wish to provide professional services (“Freelancers” or “Service Providers”) and Users who seek such professional services (“Employers”)(respectively or jointly as the “Parties” and individually as a “Party”, both known as “Users”). The Site enables Users to identify each other and work together online to complete and pay for projects.

As a Freelancer, when you propose project terms to another user, you are creating and agreeing to a contract. If an employer chooses to accept your proposed terms, you have entered a contract with that employer and are responsible for providing the services agreed upon in a professional manner by the date agreed upon.

As an Employer once you select to accept a freelancer’s proposed terms, you have entered into a contract with that Freelancer and are required to pay the Freelancer based on the terms agreed upon in that proposal through Nashville For Hire’s payment facilitation system.

Nashville For Hire is not a party to this contract and merely facilitates finding freelancer and paying them for their service as agreed by both of you in the proposed terms offered by the freelancer and agreed upon by the employer.

 

Nashville For Hire does not offer any form of insurance or other Employer or Freelancer protection, because our Site merely provides the online venue for Users to offer, sell, and buy professional services and we are not otherwise involved in the transactions and interactions between Employers and Freelancers.

 

Copyright

Nashville For Hire holds no copyright or ownership of any purchases made via Nashville For Hire and all works delivered.  All above works, deliveries and purchases and their copyright status are to be discussed and decided upon by the buyer and seller.  Nashville For Hire holds no responsibility to resolve or mediate such issues and cannot be held liable for any disputes.  If a buyer and seller do not discuss copyright terms, they are responsible for whatever consequences or legal issues that arise at any point.  

 

Independent Contractors

Each User acknowledges and agrees that the relationship between Users is that of independent contractors. Nothing in this User Agreement creates a partnership, joint venture, agency or employment relationship between: (1) Users; or (2) between us and any User.

Our Site acts as an online venue to allow Users to offer and buy professional services. As a result you acknowledge and agree that Nashville For Hire has no control over the legality of the professional services provided by Users on our Site, or the ability of Freelancers to provide the services or the Employers to pay for the services. We do not guarantee that a User will actually complete the professional services or act lawfully in using the Site.

 

Nashville for Hire is not part of any services agreements you enter into with other members. There is no joint venture between any member and us. We’re not a re-supplier of services provided by service providers. Service providers are independent contractors and are not our employees, sub-contractors, partners or agents. We provide the site and not the services.

You release us from any liability relating to a dispute and the outcome of any dispute resolution process.

 

We encourage freelancers and employers to try and settle conflicts amongst themselves. If for any reason this fails, users can contact Nashville For Hire (hello@nashvilleforhire.com) and we will do our best to try and mediate, without guarantee.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Nashville For Hire

 

Nashville For Hire has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Nashville For Hire shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

 

You are responsible to scan all transferred files for viruses and malware. Nashville For Hire will not be responsible for any damages which might occur due to site usage, use of content or files transferred. 

 

Termination

Nashville For Hire reserves the right to terminate the participation of any User without reason but expressly including any User that Nashville For Hire judges to be in violation of the User Agreement. Without limiting the foregoing, Nashville For Hire may terminate the participation of a User if we think that they are creating problems, legal liabilities (actual or potential), infringing someone else’s intellectual property rights, engaging in fraudulent, immoral or illegal activities, or for other similar reasons. 

 

Code of Conduct

Rude, abusive, improper language or violent messages sent to other Nashville For Hire users will not be tolerated, and may result in termination of your account. 

 

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 14 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

 

Indemnification:

You agree to indemnify, defend and hold harmless Nashville For Hire, it’s officers, managers, members, employees, agents, attorneys, affiliates, successors and assigns, from and against any liability, loss, claim, investigation, settlement, judgment, proceeding, cost and expense, including without limitation reasonable attorneys’ fees and disbursements, whether or not a lawsuit or other proceeding is filed, that in any way arises out of or relates to (a) your breach or violation of these Terms of Service or any applicable state or federal law; or (b) your infringement of any copyright or intellectual property rights of any person or entity; or (c) your use of the Website. This provision shall survive the termination of these Terms of Service for any reason.
